If you scroll down this page, there is an update from 7/11/11 saying :

http://www.unique-photography-concepts. ... -pass.html

We have just been informed that the Wheeler Pass Road has been closed by residents because a few thoughtless individuals have been driving/riding fast, raising dust and harassing pets. When visiting the Cold Creek Area, drive slowly and please be respectful of the residents and property owners. This is a great place to explore and view Wild Horses and it could be lost to us due to the actions of a few "bone heads"!

I also found this post discussing the same situation:

Does anyone know if the whole trail is closed, or if there is a way around this? I was going to make the trip for my first time on Sunday, starting in Pahrump. I would hate to make it all the way to Cold Creek to have to turn back. Maybe I'll just check out Carpenter Canyon instead.

Thanks for helping the newbie.

John

7/11/11: There is currently a landowner on the Cold Creek side that is not letting any through traffic on the trail going through her property. The Forest Service routed the road wrong several years ago. After talking with Josh in the Las Vegas office, he said that they are awaiting the environmental survey to re route the road around her property, which could take up to two years to fully have the road open again. Until then the trail from the summit to Cold Creek is closed.

The page also mentions that vehicles have to be licensed but the area is busy with ATV traffic

ATV's should be registered and it would be nice to see some enforcement on them. They do so much harm to the few responsible organizations like ours.

I'm no legal expert, but just cruisning around the net there is much information about easements.
For example, what the land owner has done may not be legal and may be viewed as a trespass upon easement.
Blocking access to someone who has an easement is a trespass upon the right of easement and creates a cause of action for civil suit. For example, putting up a fence across a long-used public path through private property may be a trespass and a court may order the obstacle removed.

The Forest Service may want to inform the land owner of their trespass upon easement and request the land owner remove the barrier while the Forest Service works on an alternate route.

Guys, I just ran Wheeler from start to finish this weekend and saw no blockages. There is one part about 3 or so miles in where it looks lke they have built a house out of shipping containers. This looks like where the road went right in front of the "house" that has a gate on each end of the "driveway" but the road detours around it. All in all it was a fun run. We spent the first part of the day hiking in Cold Creek, following a band of Mustangs. Once we were in Cold Creek, we found the resident horses that were more people friendly. I had one of them stick his head in the truck far enough to reach my grand daughter on the passenger seat!

The trail by the way was super! There were a few places that were really rutted and took a little bit of thought to get around.
